‘Scam Run’ organizers release legal statement

ColorManila Events, Inc., organizers of the cancelled CM Challenge Davao fun run last August 12, released their official statement through their legal team.

The statement, released by the Gruba & Guzman law firm is as follows:

“We write for and on behalf of our client, COLORMANILA EVENTS, INC. (“ColorManila”), regarding its cancellation of the CM Challenge Davao which was scheduled last August 12, 2018 at SM Lanang Premier, Davao City (“Event”).”

“To set the record straight, ColorManila entered into a contract with JKL Logistics (“JKL”) on August 3, 2018 where the latter agreed to deliver equipment that will be used for the Event.”

“Despite ColorManila’s earnest and repeated efforts of reminding JKL that the Event cannot push through without the said equipment, JKL was still not able to deliver the same. Given that time was of the essence, ColorManila was left without a choice and was compelled to cancel the Event. JKL’s breach of its obligation caused irreparable damages not only to ColorManila and its outstanding repute as a fun-run organizer, but also to the hopeful participants of the Event.”

“As a result thereof, ColorManila demanded from JKL to rectify the incident and pay for the damages arising from, or in connection with, its breach. ColorManila likewise warned JKL that failure on their part to heed its demand shall cause ColorManila to institute the appropriate legal actions against them to protect and vindicate not only its rights and interests but also those of the participants.”

“Rest assured that ColorManila is undertaking all necessary measures in ensuring that JKL will be held accountable for their actions which caused the unfortunate incident. ColorManila will also be more judicious in entering into co ntracts of services in the future so as to avoid a similar incident from occurring again.”

Initially, the organizers present in the cancelled event in Davao said they will give a full refund. A text message generated to the participants however said they will only provide for a 50% refund.

In an e-mail to TIMES, the organizers clarified that “CM intends to reschedule the event and bring back the fun to the Davaoeños, so they wouldn’t propose a 100% refund.”

The event is set to be rescheduled on October 21 this year. The remaining items unclaimed by the participants will still be claimed as per CM’s advisory.

Participants who still wish to join the rescheduled fun run will be free plus will get a P 500 worth of Gift Certificate.
