NGA, GOCC projects to undergo mandatory prior consultations with city gov’t

NATIONAL government agencies (NGA) and government-owned and controlled corporations (GOCC) are now mandated to conduct prior consultations with the city before project implementation.

Mayor Sebastian Duterte signed Executive Order No. 30 series of 2024 on August 19.

EO 30 directs all NGA and GOcC that will implement national policies, programs, and/or projects within the territorial jurisdiction of the city to coordinate, consult, and involve the city government in the planning and implementation.

The order stressed that there is a high incidence of NGA proceeding with their projects within the City without prior consultation or proper coordination nor involving the City in the planning.

This leads to public inconvenience, disturbance, and negative effects on the quality of life of the Davao citizens.

EO 30 cited Section 25(b) of Republic Act No. 7160, otherwise known as the”Local Government Code of 1991,” which states that “national agencies and offices with project implementation functions, and in the discharge of these functions, to coordinate with the local government unit concerned.”

The order directs all offices concerned to submit to the city all pertinent documents related to the policy, program, or project to be implemented. 

The city shall not allow the implementation of any policy, program, or project if the concerned offices do not comply with the directives.

Upon implementation, these offices must strictly observe continued coordination with the city. 

The city government shall pursue appropriate administrative and/or criminal or civil action/s against noncompliant offices.

Further, implementing any project or program without the required prior consultation or coordination shall, if warranted, be halted.

Duterte in his third State of the City Address on August 7 hits the Department of Public Works and Highways (DPWH) anew over unfinished projects and for excavating roads without coordination.

The mayor proposed that the city will instead provide the agency with a list of projects they can do instead of repeatedly destroying roads still in good condition. 

He added the list will be identified at the barangay level as they are more aware of their needs in the community.
