The City Council passed an ordinance Tuesday requiring hazard and risk assessment as an additional requirement on the allowable use of infrastructure developments.Passed under the committee on rules, privileges, laws, and ordinances chaired by J. Melchor Quitain,
the said measure was an amendment to the existing Comprehensive Zoning Ordinance of Davao City for 2013-2022.
The amended provision refers to Sec. 1.3, Article XII of the said ordinance, which stipulates the requirements for the request for the allowable use for infrastructure developments.
Based on the draft ordinance, the Davao City Disaster Risk Reduction Management Office (CDRRMO) shall issue a hazard and risk assessment for infrastructure developments.
According to the resolution of the said ordinance, the matter “arose from the letter-complaint dated June 5, 2018 of Mr. Steve B. Baño, President of Villapark Homeowners Associations, Barangay Cabantian, Bunawan District, to resolve the flooding problem in their area.”
As amended, the requirements for allowable use now include the Barangay Council Resolution of No Objection; Barangay Development Council Resolution favorable indorsing the project; City Engineer’s Office for drainage clearance; City Environment and Natural Resources for solid waste management plan; City Health Office for sanitation clearance.
Also included are the City Assessor’s Office for new tax declaration; City Treasurer’s Office for realty tax clearance; Davao City Water District for certification of water supply availability; Davao Light and Power Company for certification of power supply availability; Mines and Geosciences Bureau for certification for possible geohazard and recommended mitigating measures;
The applicant shall also get permit from the DENR-Environmental Management Bureau for waste treatment facilities and permit to discharge effluents; Water Resource Management Council/Task Force for projects within water resource zone; Barangay Watershed Management Council and City Watershed Management Council for areas in conservation zone; Golf Construction and Development Committee; Civil Aviation Authority of the Philippines and Philippine Air Force Command Davao City; Philippine Ports Authority; National Power Corporation Davao City; and Davao City Disaster Risk Reduction Management Office for the hazard and risk assessment.
